Terms of Service.

This website is operated by Gain3d, LLC, trading as Gain3d (“we”, “us”).

This site describes our consulting services and lets you start a conversation with us. Starting a chat, calling or emailing us does not create a client relationship, and nothing on this site is an offer to contract. Engagements begin only under a separate written agreement signed by both parties.

We do not publish fixed prices. Every engagement is quoted individually after a discovery call, and the quote is set out in the written agreement.

The first month of a managed retainer is risk free. If at the end of that month you do not want to keep the service, tell us in writing before the second month is invoiced and you will not be charged our fee for that month. You remain responsible for pass-through costs incurred on your behalf during it: telephone minutes used by the service, billed at $0.50 per minute, and the cost of any third-party subscriptions we connected for you.

The custom build that precedes the retainer is provided at no charge as a joining bonus. If you end the engagement and later re-engage us, the custom build is charged at the rate quoted at that time. The written agreement governs how these terms are exercised.

You agree not to:

You are responsible for what you submit and confirm you have the right to share it. Do not send confidential, regulated, or sensitive personal information through the chat or by email — use an agreed secure channel once an engagement is underway.

The site, its text, design, and marks are ours or our licensors’ and are protected by law. You may view and print pages for your own business evaluation. Any other use — copying, republishing, redistributing, or creating derivative works — requires our written permission.

The site uses third-party services for hosting, analytics, chat, and scheduling, and may link to other sites. We do not control third-party services and are not responsible for their content, practices, or availability.

We provide the site “as is” and “as available”. We do not warrant that it will be uninterrupted, timely, secure, or error-free, and we may change or withdraw any part of it without notice.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising from your use of this site. Nothing in these terms limits liability that cannot be limited under applicable law.

You agree to indemnify us against claims, losses, and reasonable costs arising from your misuse of the site or breach of these terms.

Our Privacy Policy explains how we handle information submitted through this site and forms part of these terms.

These terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law rules. The state and federal courts serving Indiana have exclusive jurisdiction over any dispute.

We may revise these terms. The “last updated” date above reflects the current version, and continued use of the site after a change means you accept it.
